I have a question about duck hunting from a boat. There is a hunter
shooting ducks from under the rail road bridge at gales ferry marina
that is located on the Thames river.
There is a building about 200-250 feet from the rail road bridge that is used to shrink wrap boats from September to December.
The building is not occupied all the time.

Is it legal to discharge a gun with in 250 feet from the building?

Here is the regulation from the guide.

Hunting, shooting or carrying of loaded firearms within 500 feet of any building occupied by people or domestic animals or used for storage of flammable material, or within 250 feet of such buildings when waterfowl hunting in tidal areas from land shooting positions or from floating blinds anchored adjacent to land or from rock positions, is prohibited, unless written permission from lesser distances is obtained from the owner and carried. Landowners, their spouses and lineal descendants are exempt from this restriction, providing any building involved is their own.

I don't think he should be under the bridge in the first place. The newer regs are not anchoring under bridges due to Homeland Security issues.

Waterfowl hunting in tidal waters requires a distance of at least 250 feet from buildings. Any closer is a violation. Also, with USCG security zones, anchoring under a bridge, particularly a railroad bridge is not allowed.

26-66-1. Behavior and actions of hunters
(d) There shall be no hunting with firearms,discharging of firearms or carrying of loaded firearms within five hundred feet of any building occupied by people or domestic animals or used for storage of flammable or combustible materials, unless written permission of owner of such buildings is obtained and carried while hunting to allow closer shooting distances, except that the above referred to distance shall be not less than two hundred fifty feet unless written permission of owner of such buildings is obtained and carried while hunting to allow closer shooting distances when waterfowl is hunted in tidal water areas from land shooting positions or from floating blinds anchored adjacent to land or from rock formations. The provisions of this subsection shall not apply to landowners, their spouses or lineal descendants when hunting within five hundred feet of buildings owned by them or, when hunting waterfowl, within 250 feet of such buildings, but shall apply when said persons are hunting within said distances of buildings not so-owned.
